Intellectual Property Policy

This policy explains copyright, trademark, brand name, logo, product image, catalogue content, design rights, patents, counterfeit products, seller listings, custom uploads, takedown complaints, appeals, repeat infringement, and IP protection rules on CapHanu Enterprise.

📌 Overview & Purpose

CapHanu Enterprise respects intellectual property rights and expects all sellers, customers, affiliates, partners, content creators, custom product buyers, and users to respect the rights of others. This policy explains what type of intellectual property is protected, what sellers and users cannot upload or sell, how rights holders can submit complaints, how sellers can respond, and what action CapHanu Enterprise may take when infringement is reported or detected.

This policy applies to product listings, product titles, images, videos, descriptions, brand names, logos, packaging images, custom design files, digital products, reviews, Q&A, seller store pages, advertisements, banners, affiliate promotions, social media material, downloadable files, and any content submitted, displayed, sold, or promoted through CapHanu Enterprise.

This policy is for platform operation and does not replace legal advice. Rights holders, sellers, and users should consult qualified legal professionals for legal disputes, court matters, or formal IP enforcement decisions.

©️ What Intellectual Property Covers

Intellectual property may include many types of protected rights. A listing or content item may violate one or more rights even if the product is physically available in the market.

Publicity / Personality Rights Celebrity photo, influencer image, person name, face, voice, signature. Using a person’s identity for products or ads without permission.
Trade Secrets / Confidential Content Private designs, confidential catalogues, business documents, source files. Uploading confidential files or selling leaked/proprietary content.

🏢 CapHanu Enterprise Platform Content

Website design, user interface, layouts, icons, text, graphics, policy content, product page structure, brand elements, logos, banners, marketing material, custom design previews, software code, database structure, and platform content created by or for CapHanu Enterprise may be protected by intellectual property rights.

  • Users must not copy, scrape, reproduce, distribute, modify, resell, or misuse CapHanu Enterprise platform content without written permission.
  • Users must not use CapHanu Enterprise name, logo, brand identity, screenshots, banners, or content to impersonate the platform or mislead customers.
  • Affiliates, sellers, and partners may use approved brand assets only according to written permission, campaign terms, or official guidelines.
  • Unauthorized use of CapHanu Enterprise content may lead to account action, takedown request, recovery, or legal action.

🏪 Seller IP Responsibility

Sellers are fully responsible for ensuring that their products, listings, images, titles, descriptions, logos, packaging, variants, digital files, custom designs, and promotional material do not violate intellectual property rights of any person, brand, creator, manufacturer, artist, software owner, or rights holder.

  • Seller must have legal right to sell every listed product.
  • Seller must keep purchase invoices, distributor proof, brand authorization, license documents, or authenticity proof where required.
  • Seller must not use another seller’s images, descriptions, videos, catalogue data, or brand assets without permission.
  • Seller must not list counterfeit, fake, replica, pirated, copied, first-copy, master-copy, clone, or unauthorized branded goods.
  • Seller must not use brand names in product title, keyword, image, tag, or description to attract customers unless the product is genuine and seller is authorized or legally permitted.
  • Seller must immediately remove or correct listings if an IP concern is raised by CapHanu Enterprise, a rights holder, customer, or authority.
Selling counterfeit or unauthorized branded products can lead to order cancellation, refund liability, payout hold, listing removal, seller suspension, termination, and legal consequences.

🚫 Prohibited IP-related Activities

The following activities are not allowed on CapHanu Enterprise. This list is practical guidance and not exhaustive.

  • Listing fake branded goods, replica products, first-copy products, master-copy products, pirated products, or unauthorized lookalike products.
  • Using another brand’s logo, trademark, package design, product name, or model identity in a misleading way.
  • Uploading copyrighted product photos, model photos, catalogue images, videos, graphics, descriptions, or artwork without permission.
  • Selling pirated software, cracked tools, unauthorized license keys, stolen templates, copied digital downloads, or malware-related files.
  • Using celebrity photos, influencer images, sports team marks, movie characters, cartoon characters, music artwork, or public personality identity without permission.
  • Printing customer-uploaded brand logos on custom products where customer/seller has no right or authorization.
  • Creating fake brand pages, fake official seller pages, fake warranty claims, false brand authorization, or misleading product authenticity claims.
  • Copying another seller’s unique product listing, images, watermark, title, description, design, or catalogue structure without permission.
  • Misusing CapHanu Enterprise branding, screenshots, or official-looking communication to mislead users.

✅ Brand Authorization & Authenticity Proof

For branded products, high-value products, electronics, beauty, fashion, accessories, jewellery, digital goods, or any product that may create authenticity concerns, CapHanu Enterprise may request proof from sellers.

Invoice Proof Valid supplier, distributor, manufacturer, importer, or purchase invoice proving genuine sourcing.
Authorization Letter Brand, distributor, or rights-holder permission to sell or list the product where applicable.
Packaging / Label Proof Clear product packaging, barcode, batch, MRP, importer, manufacturer, warranty, or serial information.
License / Certificate Category-specific license, copyright license, software license, design permission, or compliance proof.

Failure to provide proper proof may result in listing removal, payout hold, seller restriction, or other platform action.

📩 IP Complaint / Takedown Process

Rights holders or authorized representatives may report suspected IP infringement through official CapHanu Enterprise support channels. To help us review quickly, complaints should be complete, clear, and supported by evidence.

Declaration Good-faith statement that information is accurate and complaint is authorized. To reduce false or bad-faith takedown requests.

CapHanu Enterprise may ask for additional details before taking action. Incomplete, unclear, abusive, or unsupported complaints may be delayed or rejected.

🔍 Review, Action & Temporary Removal

After receiving an IP complaint, CapHanu Enterprise may review the complaint, listing, seller history, documents, product images, customer complaints, seller proof, and available records. We may take temporary or final action depending on risk and evidence.

  • Temporarily hide, restrict, or remove the reported listing while review is pending.
  • Ask seller for invoice, brand authorization, license, certificate, or explanation.
  • Cancel pending orders if fulfilment may violate rights or harm customers.
  • Hold seller payout if counterfeit, fraud, customer refund, or legal risk exists.
  • Restore listing if complaint is unsupported or seller provides valid proof.
  • Take stronger action if infringement is confirmed or seller does not cooperate.
CapHanu Enterprise is not a court. Platform decisions are operational decisions to protect customers, sellers, rights holders, and the marketplace while respecting applicable law and evidence available to us.

⚖️ Seller Response / Counter-notice / Appeal

If a seller believes a listing was removed or restricted wrongly, the seller may submit an appeal through official support channels. Appeal should be fact-based and supported by documents.

  • Provide product ID, listing URL, seller ID, order IDs if applicable, and clear reason for appeal.
  • Submit purchase invoice, distributor proof, brand authorization, license, certificate, original content proof, or other relevant documents.
  • Explain why the product or content does not infringe the complainant’s rights.
  • Do not submit forged, edited, expired, misleading, unrelated, or unverifiable documents.
  • CapHanu Enterprise may share seller response with complainant where necessary to resolve the complaint.
  • Appeal does not guarantee listing restoration or payout release.

If both parties have a serious legal dispute that cannot be resolved through platform review, they may need to resolve it through appropriate legal channels.

🎨 Custom Design, Print & User-uploaded Content

CapHanu Enterprise may allow customers to upload names, photos, logos, artwork, text, brand marks, business designs, or other content for custom products. Customers and sellers must ensure they have the legal right to use such content.

  • Do not upload copyrighted artwork, celebrity images, movie characters, cartoon characters, sports team logos, brand logos, music artwork, or third-party content without permission.
  • Do not upload private images, personal data, or another person’s photo without consent.
  • Do not request printing of fake brand logos, counterfeit labels, fake certificates, fake IDs, or misleading official-looking material.
  • Customers are responsible for permissions related to photos, logos, names, slogans, business marks, and artwork they upload.
  • CapHanu Enterprise may reject, pause, or cancel custom orders that appear infringing, illegal, offensive, unsafe, or policy-violating.

If a custom product is created using customer-provided content, the customer agrees to indemnify CapHanu Enterprise and production partners from claims arising from unauthorized content supplied by the customer.

💾 Digital Products, Downloads & Software

Digital products need strict IP compliance because files can be copied, redistributed, or misused. Sellers and users must only upload or sell digital products they own, created, licensed, or are authorized to distribute.

  • Pirated software, cracked tools, unauthorized license keys, stolen templates, copied ebooks, leaked files, stock images without license, and malware are prohibited.
  • Digital product sellers must clearly state license terms, permitted use, restrictions, resale rights, commercial-use rights, and download limitations.
  • Buyers must not redistribute, resell, share, leak, or commercially exploit digital products beyond license terms.
  • CapHanu Enterprise may remove digital products and block downloads if IP violation is reported or detected.
  • Digital product refunds may be restricted according to product terms and applicable policies.

📢 Affiliate, Referral & Marketing Material

Affiliates, referral users, influencers, sellers, and marketing partners must respect brand and content rights while promoting CapHanu Enterprise products.

  • Do not use CapHanu Enterprise name/logo in a way that suggests official employment, support, or ownership unless authorized.
  • Do not use fake coupons, fake official pages, fake ads, fake brand partnerships, or misleading claims.
  • Do not copy seller images, brand images, product videos, or customer photos without permission.
  • Do not promote counterfeit, pirated, restricted, or infringing products through referral or affiliate links.
  • Affiliate/referral rewards may be cancelled for IP misuse or misleading promotion.

🔁 Repeat Infringer & High-risk Account Rules

CapHanu Enterprise may take stronger action against sellers or users who repeatedly violate IP rules or receive repeated valid complaints.

  • Repeated IP complaints may lead to listing restrictions, brand/category restrictions, payout hold, or document re-verification.
  • Counterfeit selling, forged authorization, or repeated fake listings may lead to permanent seller termination.
  • Users repeatedly uploading infringing custom content may lose customization access.
  • Affiliates repeatedly promoting infringing goods may lose reward eligibility or affiliate access.
  • CapHanu Enterprise may keep records of IP complaints, seller responses, moderation actions, and repeat violations for audit and legal purposes.

⚠️ False Complaints, Bad-faith Reports & Misuse

IP complaint tools must be used honestly. False complaints, competitor harassment, fake ownership claims, forged documents, or bad-faith takedown requests harm genuine sellers and platform trust.

  • Do not submit complaints if you do not own the right or are not authorized to act for the rights holder.
  • Do not misuse IP complaints to remove genuine competitor products.
  • Do not submit forged certificates, edited screenshots, fake invoices, or false legal claims.
  • CapHanu Enterprise may reject complaints, restrict reporter access, restore listings, or take further action if complaint appears false or abusive.
  • Parties may be responsible for losses caused by false or bad-faith claims.

🛡️ Actions, Penalties & Payout Hold

If IP violation is found or strongly suspected, CapHanu Enterprise may take one or more actions depending on severity, proof, customer impact, seller history, legal risk, and cooperation.

Listing Correction Minor wording, image, keyword, or brand reference issue. Seller must update listing before sale continues.
Listing Removal Unauthorized image, brand misuse, copied content, suspected infringement. Product hidden or removed from marketplace.
Order Cancellation Infringing or counterfeit product cannot be safely fulfilled. Customer refund and seller liability may apply.
Payout Hold Counterfeit, customer refund, legal complaint, or high-risk IP dispute. Seller settlement may be held until review closes.
Penalty / Recovery Seller-caused refund, legal cost, brand claim, or customer loss. Amount may be deducted from seller payout.
Account Suspension Serious or repeated infringement, fake documents, counterfeit goods. Seller/user access may be blocked.
Termination / Legal Action Severe counterfeit, piracy, fraud, or illegal activity. Account closure, reporting, and legal recovery may follow.

📚 Records, Evidence & Data Retention

CapHanu Enterprise may retain records related to IP complaints, listings, seller documents, product images, communication, moderation decisions, customer orders, payout holds, and account actions for audit, legal, tax, safety, fraud prevention, and dispute resolution purposes.

  • Complaint records may be retained even after listing removal or account closure.
  • Seller evidence and authorization documents may be stored for future verification.
  • Customer, seller, or complainant personal data will be handled according to the Privacy Policy.
  • Records may be shared with rights holders, sellers, payment partners, courier partners, legal advisors, or authorities where required and appropriate.

🔄 Policy Updates

CapHanu Enterprise may update this Intellectual Property Policy due to legal changes, marketplace expansion, seller rules, brand protection needs, digital product rules, custom product services, customer protection, fraud prevention, or platform improvements.

Updated versions will be published on this page with the latest update date. Continued selling, uploading, purchasing, promoting, or using platform content after updates means the user acknowledges the revised policy.
